Terms and Conditions for OkMerchant App

1. Introduction

Welcome to OkMerchant, a comprehensive business management mobile application developed and operated by Flyngener Techzone Private Limited, an Indian private limited company. By downloading, installing, or using the OkMerchant App (hereinafter referred to as the “App”), you agree to comply with and be bound by these Terms and Conditions (hereinafter referred to as the “Terms”). If you do not agree to these Terms, please do not use the App.

These Terms apply to all users of the App, including but not limited to merchants, traders, fish merchants, and any individual or organization utilizing the features provided by the App.

2. Definitions

• “We,” “Our,” “Us” refers to Flyngener Techzone Private Limited.
• “User,” “You,” “Your” refers to any person or entity using the OkMerchant App.
• “App” refers to the OkMerchant mobile application.
• “Content” includes all data, text, videos, audio, graphics, and information provided through the App.

3. Eligibility

You must be at least 18 years old to use the App. By agreeing to these Terms, you represent and warrant that you are of legal age and capable of entering into a legally binding agreement.

4. Description of Services

The OkMerchant App provides a variety of business tools and educational resources to support merchants and traders in managing their day-to-day operations. The features include:

• Recording and tracking auction activities (particularly in the fish trade)
• Generating and managing invoices and payment receipts
• Tracking expenses and income
• Managing dues, bills, and overall financial accounting
• Access to educational videos about business practices and how to use the App effectively

5. User Account

To access most features, you may need to create an account with us. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use of your account
• Be responsible for all activities that occur under your account

6. User Responsibilities

In compliance with Indian data protection regulations, especially those pertaining to minors:

• We restrict access to the App for users under 18 years
• We provide clear parental control and consent mechanisms for any educational material that might be accessed by minors inadvertently
• We do not share, sell, or disclose data collected from minors for commercial gain

9. Intellectual Property

All content, features, and functionality of the App (including but not limited to information, software, text, displays, images, video, and audio) are owned by Flyngener Techzone Private Limited or its licensors and are protected by Indian and international copyright, trademark, and other intellectual property laws.

10. User-Generated Content

By submitting content through the App (e.g., comments, feedback), you grant us a non-exclusive, worldwide, royalty-free, perpetual, and transferable license to use, reproduce, modify, distribute, and display such content.

• We are not liable for payment processing errors unless such error is caused solely by us

To the fullest extent permitted by law, Flyngener Techzone Private Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

16. Termination

We reserve the right to suspend or terminate your access to the App at any time for violation of these Terms or any applicable laws.

17. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or related to the App shall be subject to the exclusive jurisdiction of the courts in West Bengal, India.

18. Grievance Redressal

In accordance with the Information Technology Act, 2000 and the rules made thereunder, the name and contact details of the Grievance Officer are provided in the Privacy Policy section of the App.

20. Miscellaneous

• Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights
